Judge Puts Jailhouse Hearings on Hold

NEWTON FALLS, Ohio — A Newton Falls municipal judge who arranged to hold hearings inside the county’s jail put his plan on hold because he believes inmates have a right to an open court.

The judge halted arraignments, and preliminary and probation violation hearings until the county can arrange a way for the public to be privy to them. Ohio state law says arraignments are open to the public, but local police officials will currently not allow public hearings due to security issues.

The arrangement, originally agreed upon by the county’s sheriff and judge, was intended to save the county money in prisoner transport between the jail and Newton Falls courthouse. County officials are awaiting the installation of a video arraignment system, which will electronically link the jail and the courthouse.

The city’s law director has expressed concern about the legality of holding court in the county jail, which is located in Warren, and is also outside of the judge’s jurisdiction.
